Frequently asked questions
Can I start debt enforcement myself as a business?
Yes. Any creditor can file a debt enforcement request; no lawyer is needed. Hoop guides you through the details and files the request electronically with the debt enforcement office.
What happens after the debt enforcement request?
The debt enforcement office serves the payment order on the debtor. If they raise an objection within 10 days, the claim must be confirmed in court (setting aside the objection). Without an objection, you can file the continuation request no earlier than 20 days after service. Hoop shows you these deadlines.
What does debt enforcement cost with Hoop?
You pay a fixed price per debt enforcement request, shown before you submit. The fees of the debt enforcement office are added according to the DEBA fee ordinance; if the enforcement succeeds, the debtor bears them. You will find the rates on the Debt enforcement pricing page.
Should I order a debt enforcement register extract on the debtor first?
It is not required for the request, but often useful: the extract shows whether debt enforcement proceedings or certificates of unpaid debts already exist against the debtor. You can order it online with Hoop; for extracts on third parties, a legitimate interest must be shown.
